Welcome to our website www.medmaritime.it (hereinafter, the “Site”).

With this Privacy Policy Med Maritime S.r.l. intends to provide users of the Site (hereinafter, the “Users”) with the main information regarding the processing of their personal data related to the navigation on the Site and the use of the functionalities it offers.

Browsing within the Site is free and does not require registration, with the exception of some restricted areas, which require Users to enter special access credentials provided by Med Maritime S.r.l. (e.g., the restricted areas dedicated to Customers and Doctors). As part of their browsing, the User may freely provide a series of data concerning them in order to access specifically identified services. Thanks to the Privacy Policy, the User will be able to access all information regarding the processing of his or her personal data, pursuant to Regulation (EU) 2016/679 – General Data Protection Regulation (the “GDPR”) and the current national legislation on the protection of personal data, including Legislative Decree No. 196 of June 30, 2003 – Code on the Protection of Personal Data (the “Privacy Legislation”)

1. Data Controller and Data Protection Officer

2. Object of the processing

When browsing the Site and/or using the services it offers, the Data Controller will process various types of information concerning Users. By way of example, the following personal data (collectively, the “Data” or “Personal Data”) will be processed:

  • personal data (e.g., first name, last name);
  • contact data (e.g., e-mail, phone number);
  • browsing data (such as the IP addresses or domain names of the computers used by the Users who connect to the Site, the addresses in URI- Uniform Resource Identifier notation of the requested resources, the time of the request, the method used in submitting the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server and other parameters relating to the User’s operating system and computer environment). With reference to data relating to navigation within the Site collected through the use of “cookies” see also the following paragraph regarding cookies, to which we refer.

Some of the information described above will be collected only if you intend to take advantage of certain features offered by the Site (e.g., contact information will be collected if you choose to leave a message for the Company using the appropriate form in the “Contact Us” section).

3. Purposes and legal bases of the processing

Users’ Personal Data are collected and processed for purposes strictly related to the use, management and updating of the Site, the services offered within it and their presentation to Users (so-called Service Purposes). The specific purposes of data use are detailed in this paragraph.

(a) Use, maintenance and improvement of the services offered by the Site.
Users’ personal data are processed to ensure access to the main areas and functionalities of the Site, and in particular to:

  • enable normal and efficient enjoyment and maintenance of the Site; and
  • – improve its performance and operation.

The processing of data related to the provision of Site services and the operation of the Site does not require the consent of Users, as it is necessary for the performance of a contract between Users and the Company as well as to properly fulfill legal obligations to which the Data Controller is subject. The processing of Data for purposes of maintenance and improvement of the operation of the Site does not require the consent of the Users, as it is necessary for the pursuit of the legitimate interest of the Company and the Users in the provision of a high quality service as well as to prevent any malfunctions likely to affect the proper operation of the Site itself.

In connection with this purpose, Users’ Data may be processed by the Company for the exercise of the Controller’s rights in court and the management of litigation, as well as the prevention and suppression of unlawful acts: the Controller’s interest corresponds to the constitutionally guaranteed right of action (Art. 24 Const.) and, as such, is socially recognized as overriding the interests of the individual data subject.

(b) Contacts
Where the User sends the Company a request for information by filling out the appropriate computer form, his or her data will be processed in order to adequately handle the requests received and, where necessary, to re-contact the Users concerned.

The processing of data for this purpose does not require the consent of the Users, as it is necessary for the execution of pre-contractual measures taken at the User’s request.

4. Providing

With the exception of the data that is automatically collected to make browsing possible, some of the information requested on the Site may be marked as “mandatory” – for example, if marked with an asterisk (*) – as it is necessary to access the services offered by the Company through the Site (e.g., if you choose to send an information request using the appropriate web form).

Failure to provide the data marked as “mandatory” will result in the inability of the Data Controller to provide the requested service. Failure to provide the data marked as “optional” will not preclude access to the services offered by the Site; however, it may affect the quality or mode of delivery of the service offered or the functionality you intend to use.

Users are required to indicate on the Site only the personal data concerning them. Where personal data of third parties are indicated, Users must expressly declare and acknowledge that they have obtained the consent of third parties for the processing of the corresponding personal data by the Company, or other data controllers.

Some sections of the Site contain free-fill forms to allow Users to personalize and/or provide more information regarding their requests: please do not enter in such spaces personal data that are not functional to the request and/or other data belonging to special categories (such as, for example, data related to health), with the warning that, should they be indicated, they will be immediately deleted.

5. Methods of processing

The processing of the Users’ Personal Data is carried out, by computerized means, by means of the operations of collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, cancellation and destruction of the data. The Data are processed in compliance with applicable regulations and are protected in such a way as to minimize the risk of destruction, loss (including accidental loss), unauthorized access/use or use incompatible with the purposes of collection.

6. Data Retention

The Data Controller will process Personal Data for as long as necessary to fulfill the purposes set out in § 3 above and in accordance with any consents provided. At the end of the retention period, the data will be destroyed or anonymized. Specifically, the Data will be retained for the Purposes of Service, for no longer than 10 years from the collection, and in any case for the time of prescription by law, of the Data (subject to the Cookie Policy regarding Data collected through cookies).

7. Recipients of the Data – Access and Communication

Within the scope of the purposes indicated above, Personal Data may be accessed:

  • by persons authorized to process identified by the Data Controller pursuant to Article 29 of the Regulations, in their capacity as data processors and/or internal data processors and/or system administrators;
  • third parties who carry out activities in outsourcing on behalf of the Data Controller and who will process the Data in their capacity as data processors (e.g. suppliers of the technological infrastructure, companies that carry out activities functional to the management and maintenance of the website, professionals and consultants, internet providers, companies that provide services instrumental to the marketing and communication activities, etc.). These subjects have been adequately selected.
    The updated list of data processors, data processors and system administrators is kept at the Data Controller’s office.

Users’ Data may also be disclosed, for the above purposes, to third parties (e.g., legal consultants) who will process the data as autonomous data controllers, as well as to public administrations or competent authorities, control bodies, law enforcement agencies, and judicial and administrative authorities, at their express request or for the detection and prosecution of crimes, the prevention and safeguarding against threats to public safety, or to enable the Company to ascertain, exercise or defend a right of its own in court.

8. Transfer of Data

The Data may be transferred for the above purposes to countries outside the EU. In order to ensure an adequate level of protection of Personal Data, the transfer will take place pursuant to the approved adequacy decisions of the European Commission or the adoption by the Data Controller of the Standard Contractual Clauses prepared by the European Commission. The list of non-European countries to which data is transferred is available at the Controller’s office.

9. Cookies

The Site uses “cookies,” both technical (i.e., to facilitate navigation and use) and profiling cookies (i.e., to analyze Users and their behavior and preferences and get them personalized advertisements).

10. Rights of the data subject

The Company informs Users that, as data subjects, it has the right, unless restricted by law, to:

  • obtain confirmation of the existence or non-existence of their Personal Data, even if not yet registered, and that such data be made available to you in an intelligible form;
  • obtain indication and, where appropriate, copy: (a) the origin and category of the Personal Data; (b) the logic applied in the case of processing carried out with the aid of electronic instruments; (c) the purposes and methods of processing; (d) the identification details of the data controller and data processors; (e) the subjects or categories of subjects to whom the Data may be communicated or who may become aware of it, in particular if recipients from third countries or international organizations; f) when possible, the period of retention of the Data or the criteria used to determine this period; g) the existence of an automated decision-making process and, if so, the logic used, its importance and the expected consequences for the data subject; h) the existence of adequate safeguards in case of transfer of the Data to a non-EU country or international organization;
  • obtain, without undue delay, the updating and rectification of inaccurate data or, when interested, the integration of incomplete data;
  • Obtain the deletion, transformation into anonymous form or blocking of data, where possible: a) unlawfully processed; b) no longer necessary in relation to the purposes for which they were collected or subsequently processed; c) in case of revocation of the consent on which the processing is based and if there is no other legal basis, d) if the User has objected to the processing and there is no overriding legitimate reason to continue the processing; e) in case of fulfillment of a legal obligation; f) in the case of Data referring to minors. The Data Controller may refuse erasure only in the case of: a) exercise of the right to freedom of expression and information; b) fulfillment of a legal obligation, performance of a task carried out in the public interest or exercise of public authority; c) reasons of public health interest; d) archiving in the public interest, scientific or historical research or for statistical purposes; e) exercise of a right in court;
  • obtain the restriction of processing in the case of: a) contestation of the accuracy of personal data; b) unlawful processing by the Data Controller to prevent its deletion; c) exercise of a right in court; d) verification of whether the legitimate motives of the Data Controller prevail over those of the data subject;
  • receive, if the processing is carried out by automatic means, without hindrance and in a structured, commonly used and readable format the personal data concerning them in order to transmit them to another owner or – if technically feasible – to obtain direct transmission by the Owner to another owner;
  • oppose, in whole or in part, for legitimate reasons related to their particular situation, the processing of personal data concerning them;
  • to lodge a complaint with the Data Protection Authority.

In the above cases, where necessary, the Data Controller will bring to the attention of third parties to whom the Data are communicated the possible exercise of rights by the User, except in specific cases (e.g. when such fulfillment proves to be impossible or involves a manifestly disproportionate use of means compared to the protected right).

11. Methods of exercising rights

The User may at any time exercise its rights:

  • by sending a registered letter with return receipt to the Holder’s address;
  • by sending an email to medmaritimeinfo@gmail.com.

12. Revision Clause

The Company reserves the right to revise, modify or simply update, in whole or in part, at its sole discretion, in any manner and/or at any time, without prior notice, this Privacy Policy, including in consideration of changes in data protection laws or regulations. Changes and updates to the Privacy Policy will be notified to Users as soon as they are adopted and will be binding as soon as they are posted on the Site. We therefore kindly ask Users to regularly access the “Privacy” section to check the publication of the most recent and updated Privacy Policy.
